The 59-year-old Oscar-winning actor had argued he should be excused from attending his January 7 at the Nantucket District Court because his presence would "amplify the negative publicity already generated in connection with this case".
That charge is in addition to Rapp's accusation against the actor.Spacey is also being sued by a massage therapist in Los Angeles for alleged assault and battery, and he is under investigation in London for at least six alleged incidents of sexual misconduct.
Cape and Islands Assistant District Attorney Michael Giardino wrote that Spacey's appearance is required under state rules for criminal case procedure.

Neither Spacey nor his lawyers have addressed the allegation publicly, but the actor released a video last week in the voice of Frank Underwood, his character on Netflix's "House of Cards" in which he said, "I'm certainly not going to pay the price for the thing I didn't do".
The complainant's mother, former TV news anchor Heather Unruh, said in a 2017 news conference that Spacey had bought her son "drink after drink after drink" and had "made his move" when the boy was drunk.
Spacey was sacked from the Netflix drama amid sexual assault accusations from several men, starting with an allegation by actor Anthony Rapp who said Spacey drunkenly tried to seduce him decades ago when Spacey was 26 and Rapp was 14.
