The four senior justices, along with the CJI, are part of the Supreme Court collegium that selects judges to the apex court and high courts.

She also said "extreme interference" of the Centre in the functioning of the judiciary was "dangerous" for democracy, but did not elaborate.

"Points raised by the honourable judges need to be looked into carefully.", Rahul Gandhi said. Justice Misra became the CJI on August 28, 2017 and he is due to retire from on October 2 this year. I have no doubt that (the four) judges of the Supreme Court have good grievances against the Chief Justice of India.

Having said that, the way the apex court has functioned in the recent past has been far from ideal; today's events has put it beyond doubt that all is not well at the very top of the judiciary.

Justice Gogoi, accompanied by three other senior judges of the apex court, levelled various allegations of abuse of power and bench-fixing by the incumbent CJI.

"We will see. We will take into consideration your objections".

When asked whether they propose an impeachment of the CJI or not, the judges said: "It is the nation which will decide".

There was no immediate official response from the CJI office.

CPI leader D Raja, who created controversy by visiting Justice Chelameshawr at his home, tried to play down the episode by saying he knew the judge for a times. While it is not clear in how many cases such exceptions were made, the four judges seem to have had an issue over the petition that sought an inquiry into the death of special CBI judge B.H. Loya in 2014 being posted before a particular Bench. The press conference was held at the house of Justice Chelameswar, who is lower in seniority only to the chief justice of India.

A note caution sounded by the four judges was, "Four of us have been telling the CJI Dipak Misra to correct his ways for the sake of the institution. Somebody had to confront the situation, where Chief Justice is blatantly misusing his powers, hence the unprecedented step", Bhushan said.

In their scathing criticism of the Supreme Court's functioning, they raised issues which included that cases having "far-reaching consequences for the nation", were being "selectively" assigned to the benches of "their preference".

Though this aspect has been acknowledged by the judges in their dissenting letter, it is also pointed out that it has been a convention of the Court to list important matters before benches comprising senior judges. The Chief Justice re-allocated the case. It further added that the collegium must begin the process to fill vacancies of chief justices in high courts at least a month before vacancies arise an in accordance with the Memorandum of Procedure for Appointment (MOP) now in force, in pursuance of judgment of this Court in Supreme Court Advocates-on-Record Association and Others versus Union of India, (1993) 4 SCC 441, para 478.
